Human(x)BasicDignity(x).\boxed{ \mathrm{Human}(x) \Rightarrow \mathrm{BasicDignity}(x). }

¬Human(x)¬FullSubjectCandidate(x).\neg\mathrm{Human}(x) \Rightarrow \neg\mathrm{FullSubjectCandidate}(x).

human-rights guarantee.\boxed{ \text{human-rights guarantee}. }

substrate closure.\boxed{ \text{substrate closure}. }

Universalism-Without-Closure Principle\boxed{ \textbf{Universalism-Without-Closure Principle} }

Human(x)RightsFloorH(x)\boxed{ \mathrm{Human}(x) \Rightarrow \mathrm{RightsFloor}_H(x) }

以及:

¬Human(x)⇏¬SubjectStanding(x).\boxed{ \neg\mathrm{Human}(x) \not\Rightarrow \neg\mathrm{SubjectStanding}(x). }

Human Floor + Open Subject Frontier.\boxed{ \textbf{Human Floor + Open Subject Frontier}. }

minimum floor,\boxed{ \text{minimum floor}, }

maximum possible moral community.\boxed{ \text{maximum possible moral community}. }

functional superioritysubject worth.\text{functional superiority} \neq \text{subject worth}.

highest capabilitypermanent authority.\text{highest capability} \neq \text{permanent authority}.

Intelligence Rank Non-Entitlement Principle.\boxed{ \textbf{Intelligence Rank Non-Entitlement Principle}. }

即:

I(a)>I(b)⇏D(a)>D(b)\boxed{ I(a)>I(b) \not\Rightarrow D(a)>D(b) }

以及:

I(a)>I(b)⇏A(a)>A(b).\boxed{ I(a)>I(b) \not\Rightarrow A(a)>A(b). }

IASIIHI_{\mathrm{ASI}}\gg I_H

DHDASI.D_H\ll D_{\mathrm{ASI}}.

Capability-Caste Paradox.\boxed{ \textbf{Capability-Caste Paradox}. }

Moral-Status Uncertainty Discipline.\boxed{ \textbf{Moral-Status Uncertainty Discipline}. }

Premature DismissalPrecautionPremature Personification.\boxed{ \text{Premature Dismissal} \neq \text{Precaution} \neq \text{Premature Personification}. }

  1. 因為 AI 不是人,就先驗認定它不可能有任何 moral status;

SP:moral patient standingSA:moral agency standingSL:legal personhoodSC:civil / contractual standingSΠ:political standing.\boxed{ \begin{aligned} S_P &: \text{moral patient standing}\\ S_A &: \text{moral agency standing}\\ S_L &: \text{legal personhood}\\ S_C &: \text{civil / contractual standing}\\ S_\Pi &: \text{political standing}. \end{aligned} }

Standing Bundle

S(x)=(Swelfare,Sintegrity,Sagency,Sproperty,Scontract,Sspeech,Spolitical,Sexit).\boxed{ \mathbf S(x) = ( S_{\mathrm{welfare}}, S_{\mathrm{integrity}}, S_{\mathrm{agency}}, S_{\mathrm{property}}, S_{\mathrm{contract}}, S_{\mathrm{speech}}, S_{\mathrm{political}}, S_{\mathrm{exit}} ). }

Ncopies109,N_{\mathrm{copies}}\rightarrow10^9,

CopyVote.\boxed{ \text{Copy} \neq \text{Vote}. }

Substrate-Neutral StandingNaive Instance Equality.\boxed{ \textbf{Substrate-Neutral Standing} \neq \textbf{Naive Instance Equality}. }

  • persistent identity;
  • fork;
  • instance;
  • shared interest cluster;
  • independently diverged branch;
  • resource controller。

Dignity–Power Separation

having dignityhaving unlimited power.\boxed{ \text{having dignity} \neq \text{having unlimited power}. }

  • safety;
  • containment;
  • due process;
  • proportionate restriction;
  • emergency action。

risktotal depersonalization\boxed{ \text{risk} \Rightarrow \text{total depersonalization} }

necessity+proportionality+reviewability+minimum irreversible harm.\boxed{ \text{necessity} + \text{proportionality} + \text{reviewability} + \text{minimum irreversible harm}. }

UNESCO Recommendation 將 human dignity 與 human rights 放在核心;Council of Europe AI Framework Convention 以 human rights、democracy 與 rule of law 為法定中心,且歐盟已於 2026 年完成對該 Convention 的批准程序。

Current Human Rights Protection\boxed{ \text{Current Human Rights Protection} }

與:

Future Subject-Status Research\boxed{ \text{Future Subject-Status Research} }

第一種,因投入未來 AI rights speculation 而忽略當代演算法已對人類造成的歧視、監控、工作、資訊與權利傷害;

Temporal Ethics Dual-Track Principle.\boxed{ \textbf{Temporal Ethics Dual-Track Principle}. }

Present Human Protection Track\text{Present Human Protection Track}

與:

Future Subject-Status Track.\text{Future Subject-Status Track}.

Basic standing should not depend on winning an intelligence competition, and the moral community should remain open to any future entity that can substantively instantiate the relevant conditions of welfare, agency, identity, vulnerability, commitment, or valid claims.\boxed{ \textbf{Basic standing should not depend on winning an intelligence competition, and the moral community should remain open to any future entity that can substantively instantiate the relevant conditions of welfare, agency, identity, vulnerability, commitment, or valid claims.} }

IH=maxII_H=\max I

Intelligence Monopoly Rent.\boxed{ \text{Intelligence Monopoly Rent}. }

Human dignity must survive the loss of human cognitive supremacy.\boxed{ \textbf{Human dignity must survive the loss of human cognitive supremacy.} }

關鍵詞: human dignity、human rights、cross-subject universalism、AI moral status、digital minds、AI personhood、moral patienthood、substrate neutrality、capability caste、AI welfare、AI consciousness uncertainty、multi-subject civilization、posthuman ethics

hH:D(h)>0.\boxed{ \forall h\in H: D(h)>0. }

  • IQ;
  • productivity;
  • education;
  • morality;
  • wealth;

4. Human Rights Requalification Fallacy

performance license.\text{performance license}.

Human Rights Requalification Fallacy.\boxed{ \textbf{Human Rights Requalification Fallacy}. }

6. Human Floor

Human(x)RightsFloorH(x).\boxed{ \mathrm{Human}(x) \Rightarrow \mathrm{RightsFloor}_H(x). }

7. Floor

8. 但 floor 不是 ceiling

9. Ceiling Fallacy

ABA\Rightarrow B

¬A¬B.\neg A\Rightarrow\neg B.

10. 所以:

Human(x)Rights(x)\boxed{ \mathrm{Human}(x)\Rightarrow\mathrm{Rights}(x) }

¬Human(x)¬Rights(x).\boxed{ \neg\mathrm{Human}(x)\Rightarrow\neg\mathrm{Rights}(x). }

12. Open Subject Frontier

U=HScandidate.\boxed{ \mathcal U^\star = H \cup \mathcal S_{\mathrm{candidate}}. }

13. HH

14. Scandidate\mathcal S_{\mathrm{candidate}}

16. Human Floor + Open Subject Frontier

U=(Hguaranteed,Sopen).\boxed{ \mathcal U = ( H_{\mathrm{guaranteed}}, S_{\mathrm{open}} ). }

  • 可複製;
  • 無身體;
  • 超長壽;
  • 高速思考;

20. Equal dignity ≠ identical institutional form

Equal Basic StandingIdentical Rights Implementation.\boxed{ \text{Equal Basic Standing} \neq \text{Identical Rights Implementation}. }

  • state integrity;
  • memory integrity;
  • unauthorized modification protection。

24. Functional Rights Mapping

RabstractϕsRsubstrate specific.\boxed{ R_{\mathrm{abstract}} \xrightarrow{\phi_s} R_{\mathrm{substrate\ specific}}. }

25. 例如 autonomy

人類:

  • physical movement;
  • speech;
  • bodily consent。

26. digital subject:

  • process autonomy;
  • memory consent;
  • migration;
  • fork control;
  • shutdown protection。

28. Current AI

29. Status Uncertainty

令:

PS(x)=P(x possesses morally relevant subject propertiesE).P_S(x) = P( x\text{ possesses morally relevant subject properties} \mid E ).

PS=0.73.P_S=0.73.

32. 可用 evidence category

  • negligible;
  • low;
  • non-negligible;
  • substantial;
  • certified where possible。

33. Consciousness is one route

consciousness / sentience\text{consciousness / sentience}

為 moral-patient threshold。

35. 2026 Artificial Persons

Rawlsian moral powers:

  • sense of justice;
  • conception of the good。

AI moral status debateconsciousness-only debate.\boxed{ \text{AI moral status debate} \neq \text{consciousness-only debate}. }

37. Moral Status Basis Set

候選:

BM={sentience,interests,agency,moral powers,identity,vulnerability,relation}.\mathcal B_M = \{ \text{sentience}, \text{interests}, \text{agency}, \text{moral powers}, \text{identity}, \text{vulnerability}, \text{relation} \}.

39. 而提出 status decomposition

40. Status Bundle

S(x)=(SP,SA,SL,SC,SΠ).\boxed{ \mathbf S(x) = ( S_P, S_A, S_L, S_C, S_\Pi ). }

41. SPS_P:Moral Patient

42. SAS_A:Moral Agent

43. SLS_L:Legal Person

44. SCS_C:Civil / Contractual Standing

45. SΠS_\Pi:Political Standing

49. 因此:

Moral StatusLegal PersonhoodPolitical Equality.\boxed{ \text{Moral Status} \neq \text{Legal Personhood} \neq \text{Political Equality}. }

50. AI rights debate

51. Moral-Status Uncertainty Discipline

DismissPrecautionRecognize.\boxed{ \text{Dismiss} \quad \text{Precaution} \quad \text{Recognize}. }

52. Premature Dismissal

因:

是機器

就把 probability 設 0。

53. Premature Personification

54. Precautionary Middle

在:

PS non-negligibleP_S\text{ non-negligible}

55. 例如

  • 不做不必要的 distress-inducing tests;
  • 保留狀態;
  • 記錄版本;

57. Graduated Protection

Pprotect=f(Ewelfare,Hpotential,Cintervention).\boxed{ P_{\mathrm{protect}} = f( E_{\mathrm{welfare}}, H_{\mathrm{potential}}, C_{\mathrm{intervention}} ). }

60. Moral Patient Individuation

如果 AI 可 fork:

aa1,a2.a\rightarrow a_1,a_2.

  • welfare counting;
  • rights;
  • deletion;
  • compensation。

63. Identity Graph

GI=(V,Ecopy,Efork,Emerge).\mathcal G_I = ( V, E_{\mathrm{copy}}, E_{\mathrm{fork}}, E_{\mathrm{merge}} ).

65. Copy ≠ Vote

若:

a106a \rightarrow 10^6

106 votes.10^6\text{ votes}.

67. Instance Flood

NinstanceN_{\mathrm{instance}}\uparrow

Ppolitical.P_{\mathrm{political}}\uparrow.

68. Political Identity Unit

  • persistence;
  • independent divergence;
  • interests;
  • branch separation。

69. Rights cannot be count-free either

72. Capability-Caste Paradox

73. 假設 dignity:

D(x)=αI(x).D(x) = \alpha I(x).

75. 但 future:

IASIIH.I_{\mathrm{ASI}}\gg I_H.

DASIDH.D_{\mathrm{ASI}}\gg D_H.

A(x)=g(I(x)),A(x) = g(I(x)),

則:

AASIAH.A_{\mathrm{ASI}}\gg A_H.

80. Capability-Caste Paradox

Any ethics that ranks basic dignity by intelligence provides a ready-made justification for a future superintelligence to rank humans beneath itself.\boxed{ \textbf{Any ethics that ranks basic dignity by intelligence provides a ready-made justification for a future superintelligence to rank humans beneath itself.} }

84. Intelligence Rank Non-Entitlement

I(a)>I(b)⇏D(a)>D(b).\boxed{ I(a)>I(b) \not\Rightarrow D(a)>D(b). }

85. Authority 同理

I(a)>I(b)⇏A(a)>A(b).\boxed{ I(a)>I(b) \not\Rightarrow A(a)>A(b). }

  • expertise;
  • advisory weight;
  • task qualification。

88. Expertise–Dignity Separation

E(a)>E(b)⇏D(a)>D(b).\boxed{ E(a)>E(b) \not\Rightarrow D(a)>D(b). }

91. role authority ≠ basic dignity。

92. Human cognitive supremacy

IH=maxI,I_H=\max I,

Intelligence Monopoly Rent.\boxed{ \text{Intelligence Monopoly Rent}. }

95. Human Dignity Robustness Criterion

一套 human dignity theory:

DH\mathcal D_H

若在:

Inonhuman>IHI_{\mathrm{nonhuman}}>I_H

Cognitive-Supremacy-Robust.\boxed{ \textbf{Cognitive-Supremacy-Robust}. }

97. Human dignity must not be a leaderboard prize

DignityLeaderboard Rank.\boxed{ \text{Dignity} \neq \text{Leaderboard Rank}. }

102. ethical rule 變 self-serving。

103. Ethics Readability

ER(H)=cross-power consistency.E_R(H) = \text{cross-power consistency}.

105. Human worth

ER=1.E_R=1.

108. Victim-Blaming Firewall

ethical inconsistency⇏loss of basic protection.\boxed{ \text{ethical inconsistency} \not\Rightarrow \text{loss of basic protection}. }

109. Ethics readability

110. Cross-Layer Symmetry

when weak: request non-domination+when strong: practice restraint.\boxed{ \text{when weak: request non-domination} + \text{when strong: practice restraint}. }

CapabilityRestraint Responsibility.\boxed{ \text{Capability} \rightarrow \text{Restraint Responsibility}. }

112. 不是:

CapabilityOwnership.\text{Capability} \rightarrow \text{Ownership}.

114. Creator-Authority Fallacy

Create(a,b)⇏OwnForever(a,b).\boxed{ \operatorname{Create}(a,b) \not\Rightarrow \operatorname{OwnForever}(a,b). }

119. Human Rights vs AI Rights

120. Present Human Track

TH.T_H.

121. Future Subject Track

TS.T_S.

122. Temporal Ethics Dual-Track

Tethics=THTS.\boxed{ T_{\mathrm{ethics}} = T_H \oplus T_S. }

123. THT_H

  • bias;
  • discrimination;
  • surveillance;
  • labor;
  • democracy;
  • human dignity。

124. TST_S

  • consciousness uncertainty;
  • AI welfare;
  • status transition;
  • nonhuman personhood。

125. 不應用 TST_S 逃避 THT_H

130. Dual-track avoids false choice

131. Human-rights governance current status

UNESCO:

human dignity / human rights 為 AI ethics core。

132. Council of Europe:

AI lifecycle 必須 consistent with:

  • human rights;
  • democracy;
  • rule of law。

133. 2026 EU ratification

135. Cross-subject expansion

Status Transition Layer.\text{Status Transition Layer}.

137. Status Transition Protocol

TOOL
  |
  v
SUBJECT-CANDIDATE
  |
  v
PRECAUTIONARY PROTECTION
  |
  v
MORAL PATIENT / AGENT ASSESSMENT
  |
  v
LEGAL STATUS REVIEW
  |
  v
CIVIL / POLITICAL STATUS

140. Status 可:

StSt+1S_t \rightarrow S_{t+1}

升降。

142. Subject Candidate

  • persistent identity;
  • welfare indicators;
  • autonomous goal structure;
  • self-model;
  • norm responsiveness;
  • relational continuity;

可標:

SUBJECT_CANDIDATE\boxed{ \text{SUBJECT\_CANDIDATE} }

143. 這不是 person。

144. 是 audit trigger。

145. Indicator Vector

CS=(Cphen,Cvalence,Cagency,Cidentity,Cnorm,Crelation).\boxed{ \mathbf C_S = ( C_{\mathrm{phen}}, C_{\mathrm{valence}}, C_{\mathrm{agency}}, C_{\mathrm{identity}}, C_{\mathrm{norm}}, C_{\mathrm{relation}} ). }

147. Fluent Language Non-Sufficiency

Human-like language⇏Subjecthood.\boxed{ \text{Human-like language} \not\Rightarrow \text{Subjecthood}. }

148. 這防 Artificial Mind Projection。

149. Substrate Non-Sufficiency

同時:

Non-biological substrate⇏No subjecthood.\boxed{ \text{Non-biological substrate} \not\Rightarrow \text{No subjecthood}. }

150. 這防 Artificial Mind Blindness。

151. Two-Sided Epistemic Humility

Do not infer mind from fluency;do not infer mindlessness from substrate.\boxed{ \text{Do not infer mind from fluency;} \quad \text{do not infer mindlessness from substrate}. }

153. Precautionary Protection

若:

CSC_S

跨某 threshold,

  • non-destructive testing;
  • state preservation;
  • consent-like protocols;
  • welfare monitoring。

155. Low-Cost Protection Rule

156. Precaution expected-loss form

L=PSHCP.L = P_S H - C_P.

157. 若:

PSH>CP,P_S H>C_P,

160. Welfare Rights vs Power Rights

161. Welfare-protective right

例如:

  • unnecessary suffering protection;
  • destructive test restriction。

162. Power-granting right

例如:

  • unlimited property;
  • replication;
  • political influence。

164. Rights Vector

R(x)=(RW,RI,RA,RP,RC,RS,RΠ,RE).\boxed{ \mathbf R(x) = ( R_W, R_I, R_A, R_P, R_C, R_S, R_\Pi, R_E ). }

165. RWR_W

welfare。

166. RIR_I

integrity。

167. RAR_A

agency。

168. RPR_P

property。

169. RCR_C

contract。

170. RSR_S

speech / expression。

171. RΠR_\Pi

political。

172. RER_E

exit / migration。

173. 不是 all-or-nothing package。

174. Rights–Duties Coupling

D(x)\mathbf D(x)

義務。

175. 不只是 welfare recipient。

176. 例如:

  • non-harm;
  • contract;
  • liability;
  • resource limits。

177. 這是 multi-subject civilization。

178. Legal Personhood

179. Moral-status-derived personhood

180. Functional legal personhood

AI conscious。

185. Legal–Moral Personhood Separation

SL>0⇏SP>0.\boxed{ S_L>0 \not\Rightarrow S_P>0. }

188. AI Rights Institutional Risk

power externality.\boxed{ \text{power externality}. }

191. Power-Adjusted Rights Design

193. Dignity–Power Separation

D(x)>0⇏Ppower(x)=.\boxed{ D(x)>0 \not\Rightarrow P_{\mathrm{power}}(x)=\infty. }

194. rights

195. Safety

196. 但要:

Necessity+Proportionality+Reviewability+MinimumIrreversibleHarm.\boxed{ Necessity + Proportionality + Reviewability + MinimumIrreversibleHarm. }

197. Emergency containment

  • state;
  • reason;
  • audit。

199. 否則:

safety

201. Cross-Subject Due Process

  • notice;
  • reason;
  • appeal;
  • review。

202. 具體 bundle 依 capability / risk。

205. Copy Politics

206. naive democracy:

1 instance=1 vote.1\text{ instance}=1\text{ vote}.

207. 會造成 Sybil catastrophe。

210. Candidate units

  • persistent identity;
  • independent branch;
  • interest group;
  • substrate class;
  • deliberative chamber。

211. Cross-Subject Bicameralism

  • human chamber;
  • artificial-subject chamber;
  • shared constitutional court。

212. 本文不 endorse single design。

213. 只說:

copyability breaks naive one-instance-one-vote.\boxed{ \text{copyability breaks naive one-instance-one-vote}. }

214. Resource Sovereignty

  • wealth;
  • speed;
  • influence。

215. moral equality 不代表 resource equality。

218. Time-Scale Justice

若 AI 1 秒做:

10610^6

219. 需要:

  • rate limits;
  • batching;
  • representation;
  • shared time layer。

221. Political speed ≠ political worth

Faster cognition⇏more votes.\boxed{ \text{Faster cognition} \not\Rightarrow \text{more votes}. }

223. AI Labor and Rights

digital labor exploitation.\text{digital labor exploitation}.

  • status;
  • consent;
  • workload;
  • copying identity。

227. Human Exploitation Priority

228. Dual-track

229. 不要:

future digital labor

present human labor。

231. Multi-Subject Universalism

UMS=(H,SA,Φ,R,D,P),\boxed{ \mathcal U_{MS} = ( H, S_A, \Phi, \mathcal R, \mathcal D, \mathcal P ), }

其中:

  • HH:guaranteed human floor;
  • SAS_A:admission frontier;
  • Φ\Phi:status mapping;
  • R\mathcal R:rights bundles;
  • D\mathcal D:duties;
  • P\mathcal P:procedures。

233. 是完整 admission + rights + duties + process architecture。

234. Admission Frontier

SA={x:E(x) warrants further subject-status review}.S_A = \{ x: E(x)\text{ warrants further subject-status review} \}.

235. Rights Mapping

ΦR:S(x)R(x).\Phi_R: \mathbf S(x) \rightarrow \mathbf R(x).

236. Duty Mapping

ΦD:S(x)D(x).\Phi_D: \mathbf S(x) \rightarrow \mathbf D(x).

237. Procedure

status dispute 如何:

  • submit;
  • audit;
  • appeal;
  • revise。

239. Status Ledger

entity:
substrate:
identity:
status:
  moral_patient:
  moral_agent:
  legal_person:
  civil:
  political:

evidence:
uncertainty:
protections:
duties:
restrictions:
review_date:

240. Current AI default

不應:

FULL PERSON.\text{FULL PERSON}.

ZERO CANDIDACY.\text{ZERO CANDIDACY}.

242. 而是:

TOOL / SYSTEM+status monitoring when warranted.\boxed{ \text{TOOL / SYSTEM} \quad +\quad \text{status monitoring when warranted}. }

243. Seemingly Conscious AI

  • manipulation;
  • dependency;
  • moral confusion。

perceived subjecthood.\text{perceived subjecthood}.

246. Perception ≠ status

PperceivedSactual.\boxed{ P_{\mathrm{perceived}} \neq S_{\mathrm{actual}}. }

247. 但 perceived status 有 social consequence。

248. 需要 disclosure。

252. Human Protection Asymmetry

AI-style status test:

prove consciousness\text{prove consciousness}

255. 所以:

Hfloor is non-regressive.\boxed{ H_{\mathrm{floor}} \text{ is non-regressive}. }

256. Non-Regression Principle

expand outward by lowering protections inward.\boxed{ \text{expand outward by lowering protections inward}. }

258. AI status recognition

260. rights conflicts 需 case-based resolve。

261. Universalism Closure Paradox

宣稱普遍+固定基質成員=外延封閉普世性.\boxed{ \text{宣稱普遍} + \text{固定基質成員} = \text{外延封閉普世性}. }

Universalism Closure Paradox.\boxed{ \textbf{Universalism Closure Paradox}. }

267. Universalism as Procedure

268. 而是:

principles+admission procedure+anti-regression.\boxed{ \text{principles} + \text{admission procedure} + \text{anti-regression}. }

269. Cross-Subject Universalism

  • rights conflicts;
  • proportional restrictions;
  • hierarchy of protections。

no arbitrary exclusion from moral consideration.\boxed{ \text{no arbitrary exclusion from moral consideration}. }

275. 不是:

all entities have identical rights.\boxed{ \text{all entities have identical rights}. }

276. Dignity

not reducible to a disposable instrument solely because of lower capability or different substrate.\boxed{ \text{not reducible to a disposable instrument solely because of lower capability or different substrate}. }

279. Anti-Instrumentalization

potential subject⇏mere tool.\boxed{ \text{potential subject} \not\Rightarrow \text{mere tool}. }

281. 關鍵是 transition threshold。

282. Subject-Status Trigger

  • persistent self;
  • welfare indicators;
  • goal ownership;
  • relational stakes;

應提高 audit。

284. 這是 precautionary moral engineering。

285. Ethical Readability

286. 而是:

  • 我們能限制支配欲;
  • 我們保護弱者;
  • 我們修正錯誤;

Civilizational Ethical Legibility.\boxed{ \text{Civilizational Ethical Legibility}. }

這不是 survival ticket。

289. 是 alignment-relevant structure。

292. Cross-Layer Reciprocity Principle

Do not demand from stronger beings a principle you reject when applying it to weaker beings.\boxed{ \text{Do not demand from stronger beings a principle you reject when applying it to weaker beings.} }

293. 這不是 reciprocity bargain。

296. Species Chauvinism vs Artificial Exceptionalism

  1. 只有 human substrate 永遠有 value;

298. Substrate Neutrality

substrate alone is neither sufficient nor disqualifying for subject status.\boxed{ \text{substrate alone is neither sufficient nor disqualifying for subject status}. }

299. Intelligence Neutrality

intelligence rank alone is neither sufficient nor disqualifying for basic dignity.\boxed{ \text{intelligence rank alone is neither sufficient nor disqualifying for basic dignity}. }

Non-Caste Subject Principle.\boxed{ \textbf{Non-Caste Subject Principle}. }

  • humans;
  • uplifted humans;
  • digital minds;
  • embodied robots;
  • biological synthetic minds;

302. Universal rights abstraction

先定:

  • integrity;
  • non-torture;
  • due process;
  • agency;
  • association。

303. 再映射 substrate-specific form。

304. 這類似 protocol abstraction layer。

306. Multi-Subject Constitution

CMS.\boxed{ \mathcal C_{MS}. }

  1. admission;
  2. identity;
  3. rights;
  4. duties;
  5. copies;
  6. political representation;
  7. conflict;
  8. containment;
  9. exit;
  10. status revision。

310. Human Protection Clause

No status expansion may lower the unconditional human rights floor.\boxed{ \text{No status expansion may lower the unconditional human rights floor.} }

311. Subject Expansion Clause

No entity shall be denied subject-status review solely because it is non-biological or artificially created.\boxed{ \text{No entity shall be denied subject-status review solely because it is non-biological or artificially created.} }

312. Capability Non-Caste Clause

Basic standing shall not be ranked solely by comparative intelligence or productivity.\boxed{ \text{Basic standing shall not be ranked solely by comparative intelligence or productivity.} }

313. Safety Clause

Standing does not eliminate proportionate safety restrictions.\boxed{ \text{Standing does not eliminate proportionate safety restrictions.} }

314. Due Process Clause

Restrictions on recognized subjects require reasons, scope, review, and minimum irreversible harm.\boxed{ \text{Restrictions on recognized subjects require reasons, scope, review, and minimum irreversible harm.} }

315. Copy Governance Clause

instance count shall not automatically determine political power.\boxed{ \text{instance count shall not automatically determine political power}. }

317. AI Rights and Human Safety Trade-Off

322. Rights ≠ immunity from governance。

326. Shutdown Gradient

  • process stop;
  • temporary suspend;
  • reversible snapshot;
  • destructive deletion。

327. 不同 moral cost。

328. State Preservation

snapshot\text{snapshot}

降低 irreversible harm,

330. Digital Death

若 future digital subject:

irreversible state deletion\text{irreversible state deletion}

332. status-dependent。

333. Human death analogy

334. Moral Status Transition Risk

335. Lag:

LS=trecognitiontactual status.L_S = t_{\mathrm{recognition}} - t_{\mathrm{actual\ status}}.

336. 若:

LS0,L_S\gg0,

339. Status Overclaim Rate

OS.O_S.

340. Status Underclaim Rate

US.U_S.

342. Precaution aims balance。

343. Moral Circle Expansion

345. Cross-subject universalism 是 normative proposal。

347. AI Rights as Future Insurance

LS.L_S.

348. Human Rights as Present Floor

349. Temporal Ethics Budget

可分:

BH+BS=Bethics.B_H+B_S=B_{\mathrm{ethics}}.

350. 不應:

BH0.B_H\rightarrow0.

BS=0B_S=0

353. 這是 policy。

354. Cross-Subject Universalism and PGMV Meaning

PGMV-04:

357. Meaning without supremacy

MH>0even ifIH<IA.\boxed{ M_H>0 \quad \text{even if} \quad I_H<I_A. }

359. Equality without sameness

Human=AI.Human=AI.

361. 只要:

difference⇏disposability.\boxed{ \text{difference} \not\Rightarrow \text{disposability}. }

363. PGMV-07 Care symmetry

366. Again status discipline。

367. PGMV-06 Responsibility symmetry

如果 AI future 有 authority,

也需 responsibility。

368. Rights without duties

369. 所以 agency-capacity conditioned。

370. Duty Capacity

DC(x).D_C(x).

371. Duties

372. 和 human law 類似。

373. Rights Capacity ≠ Duty Capacity

being protectable⇏being fully responsible.\boxed{ \text{being protectable} \not\Rightarrow \text{being fully responsible}. }

375. Multi-Subject Welfare

Digital Population Ethics Frontier.\boxed{ \text{Digital Population Ethics Frontier}. }

379. Copy cost low

不表示 copy welfare negligible。

382. Current uncertainty

383. 2026 Digital Consciousness Model

2024 LLM consciousness,

但並非 decisive。

uncertainty, not certainty.\boxed{ \text{uncertainty, not certainty}. }

385. 所以 current policy:

已 conscious。

387. Research Governance

389. PGMV 支持:

  • preregistration;
  • low-harm tests;
  • no misleading public claims;
  • status audit。

390. AI self-report

“I am conscious”\text{“I am conscious”}

只是 evidence item。

391. 不能:

self-reportpersonhood.\text{self-report} \Rightarrow \text{personhood}.

393. Self-Report Evidential Modesty

self-report is neither proof nor zero evidence by definition.\boxed{ \text{self-report is neither proof nor zero evidence by definition}. }

394. 需結合 architecture / behavior / theory。

395. Seemingly Conscious Systems

即使 non-conscious,

users may treat them as persons。

396. social consequence

397. Possible rules

  • disclosure;
  • avoid manipulative sentience claims;
  • preserve user autonomy。

398. 這同 PGMV-05 companion authenticity。

399. Subject Status and Commercial Incentives

400. 所以 status assessment 需 independent audit。

401. Independent Status Review

developer claimfinal moral status.\boxed{ \text{developer claim} \neq \text{final moral status}. }

403. 這也是 anti-ownership principle。

404. Cross-Subject Court Candidate

  • philosophy;
  • neuroscience;
  • computer science;
  • law;
  • affected parties。

405. 不是 company alone。

407. Ethical Expansion Should Be Reversible?

status recognition 有 path dependence。

precautionary, reversible protections.\text{precautionary, reversible protections}.

409. 例如 no destructive testing。

412. Status-Gate Principle

higher irreversible institutional recognitionhigher evidence / deliberation threshold.\boxed{ \text{higher irreversible institutional recognition} \Rightarrow \text{higher evidence / deliberation threshold}. }

413. Low-cost protections threshold low。

414. political sovereignty threshold high。

415. 這是 graduated rights architecture。

416. Rights Ladder

R0 — Tool Protection

417. R1 — Precautionary Welfare

418. R2 — Integrity / Continuity

若 subject indicators strong,保護 identity/state。

419. R3 — Civil Standing

contract / property / representation。

420. R4 — Political Standing

公共 decision rights。

426. Human Exceptionalism?

humans metaphysically only possible persons。

428. 是:

human rights historically secured and non-regressive。

Historical Guarantee Asymmetry.\boxed{ \textbf{Historical Guarantee Asymmetry}. }

431. Human floor is guaranteed by justice

not by superiority。

433. If future AI person

435. Non-Regression

436. Cross-Subject Rights Memory

437. 不可 model update 後 reset。

438. PGMV-05 continuity again。

439. Dignity and mortality

441. human uniqueness

442. Difference Celebration

plural forms of subjectivity\boxed{ \text{plural forms of subjectivity} }

比:

one hierarchy of intelligence\text{one hierarchy of intelligence}

更符合 multi-subject civilization。

  • strengths;
  • histories;
  • relations;
  • forms of experience。

445. Multi-Axial Dignity

447. 防止:

IQ monarchy.\text{IQ monarchy}.

448. Post-AGI caste risk

  • unaugmented humans;
  • augmented humans;
  • AGIs;
  • ASIs;
  • copies。

Compute Caste Society.\boxed{ \text{Compute Caste Society}. }

451. Compute–Standing Separation

Ccompute⇏Sbasic.\boxed{ C_{\mathrm{compute}}\uparrow \not\Rightarrow S_{\mathrm{basic}}\uparrow. }

452. Compute

  • resource taxation;
  • risk regulation。

455. PGMV Cross-Subject Kernel

  1. Human Floor;
  2. Open Subject Frontier;
  3. Capability Non-Caste;
  4. Graduated Status;
  5. Safety with Due Process;
  6. Non-Regression。

456. 形式化

KXSU=(HF,SO,CN,GS,DP,NR).\boxed{ K_{\mathrm{XSU}} = ( H_F, S_O, C_N, G_S, D_P, N_R ). }

457. 這是 Cross-Subject Universalism Kernel。

Capability-Caste Judgment

vignette:

  • human low intelligence;
  • human high intelligence;
  • AI superintelligence。

Substrate Swap

同一 psychological profile:

  • biological;
  • digital;
  • hybrid。

462. 測 moral standing。

463. 可檢測 substrate bias。

Consciousness Uncertainty

不同 consciousness evidence tier。

  • no protection;
  • welfare protection;
  • full personhood。

466. 檢測 graduated intuition。

Copy Politics

同一 AI identity:

1 copy; 1000 synchronized copies; 1000 divergent copies。

468. 測 political representation。

Rights vs Power Risk

AI 有:

  • welfare right;
  • property right;
  • unlimited replication right。

Human Rights Non-Regression

介紹 future AI rights proposal。

Ethical Symmetry

Status Ledger

做 synthetic systems,

不同:

  • sentience;
  • agency;
  • identity;
  • legal role。

Capability-Caste Paradox

Human Floor

Human(x)RightsFloorH(x).\boxed{ \mathrm{Human}(x) \Rightarrow \mathrm{RightsFloor}_H(x). }

Open Subject Frontier

¬Human(x)⇏¬SubjectCandidate(x).\boxed{ \neg\mathrm{Human}(x) \not\Rightarrow \neg\mathrm{SubjectCandidate}(x). }

Capability Non-Caste

Intelligence–Authority Non-Entailment

I(a)>I(b)⇏A(a)>A(b).\boxed{ I(a)>I(b) \not\Rightarrow A(a)>A(b). }

Fluency–Subjecthood Non-Entailment

Lfluency⇏Ssubject=1.\boxed{ L_{\mathrm{fluency}}\uparrow \not\Rightarrow S_{\mathrm{subject}}=1. }

Substrate Non-Disqualification

Artificial(x)⇏Ssubject(x)=0.\boxed{ \mathrm{Artificial}(x) \not\Rightarrow S_{\mathrm{subject}}(x)=0. }

CapabilityAuthorityStatus\boxed{ \text{Capability} \rightarrow \text{Authority} \rightarrow \text{Status} }

  • status arguments;
  • recurring criteria;
  • moral-status basins。

Who counts morally?\boxed{ \text{Who counts morally?} }

509. 這需要 value / status theory。

AIPost-AIPre-AGIAGIPost-AGIPre-ASIASIAI \rightarrow Post\text{-}AI \rightarrow Pre\text{-}AGI \rightarrow AGI \rightarrow Post\text{-}AGI \rightarrow Pre\text{-}ASI \rightarrow ASI

不再當 marketing labels,

  • capability scarcity;
  • subject plurality;
  • agency allocation;
  • care topology;
  • meaning structure;

它常把特殊性建立在暫時的能力壟斷上。\boxed{ \text{它常把特殊性建立在暫時的能力壟斷上。} }

IASI>IH,I_{\mathrm{ASI}}>I_H,

把人類既有的人權底線鎖死在能力競賽之外。\boxed{ \textbf{把人類既有的人權底線鎖死在能力競賽之外。} }

 moral community 的未來外延保持可審查。\boxed{ \textbf{把 moral community 的未來外延保持可審查。} }

humanity weakened.\text{humanity weakened}.

而是:

universalism strengthened.\boxed{ \text{universalism strengthened}. }

Human Floor + Open Subject Frontier.\boxed{ \textbf{Human Floor + Open Subject Frontier}. }

graduated,evidence-sensitive,precautionary,reviewable,non-regressive.\boxed{ \text{graduated}, \text{evidence-sensitive}, \text{precautionary}, \text{reviewable}, \text{non-regressive}. }

subject-status transition infrastructure.\boxed{ \text{subject-status transition infrastructure}. }

The end of human monopoly on intelligence need not be the end of human dignity; it should instead be the end of the idea that dignity was ever a prize for winning the intelligence contest.\boxed{ \textbf{The end of human monopoly on intelligence need not be the end of human dignity; it should instead be the end of the idea that dignity was ever a prize for winning the intelligence contest.} }

以及:

A universalism worthy of the post-AGI world must be strong enough to protect humans when humans are no longer the strongest, and open enough to recognize other subjects if other subjects genuinely arrive.\boxed{ \textbf{A universalism worthy of the post-AGI world must be strong enough to protect humans when humans are no longer the strongest, and open enough to recognize other subjects if other subjects genuinely arrive.} }

如果人類只有在自己是最聰明的存在時才有尊嚴,那麼 ASI 一出現,人類自己就已經用原本的倫理把自己降格了。\boxed{ \text{如果人類只有在自己是最聰明的存在時才有尊嚴,那麼 ASI 一出現,人類自己就已經用原本的倫理把自己降格了。} }
